3 Tips For Anybody Getting Divorced

Law Blog

Going through a divorce is something that nobody wants to go through, and if you are, chances are that it's the first time you are going through it. It is important to follow these tips to ensure that things go smoothly for you.

Assume Everything You Do Or Say Is Being Documented

A common mistake that people make is doing and saying things that come back to bite them during divorce proceedings. You would be surprised at how many times a certain conversation is recalled, old text messages or brought up, or a copy of an old email is produced. A good rule of thumb is to assume that everything you do or say is being documented and can be used against you during the divorce proceedings. Before you say anything to your spouse, ask yourself if it would look good to you if what you say is repeated in court. If not, then do not say it. Things that you do or say can hurt you later on, so it is best to be on your best behavior during this tough situation.

Move Out If You Can't Keep Cool

It is easy to be very emotional during a divorce which can cause you to lose your cool and tempers to fly. If you feel like you are getting to this point, then move out of the house so that you can separate yourself from your spouse. It may be best to not be around them if they are bringing out the worst in you. You do not want to accidentally do something that can hurt your case in court.

One thing to keep in mind is that leaving the house may make it tough to get it back later. However, leaving the house does not automatically mean that you will lose it. The situation gets complicated when kids are involved and you want them to maintain their standard of living. If you don't have kids and don't have to worry about custody, it will be easier to get the house back later on.

Get Documentation Of Assets Early On

It is a good idea to start documenting assets while you have access to this information. This includes documents that show who owns which assets, statements with bank account information, and things of that nature. The more documentation you get early on will prevent you from having to do a deep dive into assets later on during divorce proceedings.
